Car accidents occur on a regular basis across the state. While the vast majority of these accidents may be considered minor fender benders, there are those that, sadly, have fatal consequences. Surviving family members of victims who have been killed in a fatal car wreck in Maryland may be entitled to file a wrongful death claim against the individual deemed responsible — if any negligence is suspected of contributing to the crash.
Recently, a 51-year-old woman died shortly after her vehicle was struck by a pickup in Olney. The victim was apparently headed eastbound on Route 108 when a truck in the westbound lane crossed the centerline and struck her car. She was transported to a nearby medical facility for treatment, but the extent of her injuries was too significant. She died soon after arriving at the hospital.
The driver of the pickup, a 25-year-old man, was also injured in the collision and was transported to a hospital for care. This individual is an employee at Francis O Day Company and was supposedly working at the time of the incident. The truck is reportedly registered to the company.
According to police, drugs and/or alcohol are not considered to have been contributing factors in the crash, though drowsy driving may be. At this time, it is unknown if any charges will be filed in this case. An accident reconstruction team is still in the process of investigating this incident.
Fatal car accidents like this one are likely to leave any surviving family members with a lot of questions and searching for closure. On top of trying to cope with their loss, they may also experience financial difficulties due to the unexpected expenses incurred as a direct result of the crash — such as medical and funeral expenses. A wrongful death claim may be an appropriate legal remedy that, if successfully litigated, could grant the victim’s family compensation for the financial losses they have suffered due to this tragic event. This claim, which would be filed in a Maryland civil court, could be brought against not only the driver of the truck, but possibly his employer as well.
