Man assaulted in pharmacy, files lawsuit against Rite Aid

When a person goes to the pharmacy in Baltimore to fill a prescription, they do so with the expectation that the prescription will help them feel better. After all, the major goal of pharmacies is to help their customers heal and improve their health. A customer would very rarely consider coming away from the shopping experience in worse shape than when he went in.

Unfortunately, this was the case for one customer who visited a Rite Aid in Philadelphia in 2012. The man was attacked and robbed by three men while he was inside the store. Though he says he tried to get help from employees and security personnel inside the store, no one would come to his aid.

The man filed a premises liability against the pharmacy, saying that it did not provide a safe place for its customers and was negligent. The lawsuit was dismissed by the Philadelphia Court of Common Pleas because it did not name the assailants as indispensable parties, but that decision was recently thrown out by the state Superior Court panel. They said it was unnecessary to include the assailants because the pharmacy failed to take reasonable steps to prevent the incident from happening. The case was sent back to Philadelphia in order to hear the rest of the preliminary objections.
