Mother files medical malpractice suit after death of new baby

Labor and delivery can be a joyful yet stressful time for expectant parents in Baltimore. It is the culmination of nine months’ worth of hope and preparation. For many women, pregnancy and labor is not an easy thing, but once their baby is born, it is all worth it.

A new mother was robbed of her opportunity to welcome her new baby into the world. The baby was not breathing and did not have a heartbeat when she was delivered on November 15, 2011. She was also unresponsive to the efforts of medical staff and was eventually pronounced dead just under an hour after she was delivered.

The mother, who was 30 years old at the time, went to the hospital in order to be induced. Her labor was started just before 5:00 a.m. Although there were indications that the fetus was in distress at different times during the day, there were no actions taken by the medical professionals that attended to her.

The woman recently retained a lawyer and filed a medical malpractice lawsuit against two doctors, the hospital and a midwife saying that her baby’s death could have been prevented if there had been proper monitoring in place. Her lawyer stated that if a C-section would have been performed, the baby would have lived.

This woman has had to endure heartache that no mother should over something that was apparently preventable. Hopefully her lawsuit will enable her to be properly compensated for the death of her baby, her medical bills, pain and suffering and funeral costs.
